General Terms and Conditions
  Welcome to GC Team NZ! By setting up your card details, you automatically agree to the following terms and conditions:

Definitions:
● GC Team NZ, we, our: GC TEAM ASSOCIATION NZ LIMITED
● You, Your: Refers to you, the Trial member of GC Team.
● Contract: The contract between GC Team and you, under which you will be a member of GC Team.
● Rules: The rules governing the operation of the equipment, class schedule, behavior within GC Team, and any information specified in signage and paraphernalia.
● In consideration for permission to participate in any form in the classes, events, and/or activities of GC TEAM ASSOCIATION NZ LIMITED, I, the Participant

1. Formation of the Contract:
   a. A contract arises between us once the contract is signed and GC Team accepts the contract.
2. Acceptance by GC Team of the Contract:
   a. If there is any conflict between the terms of this contract and any verbal or telephone communication, the terms of this contract will prevail.
   b. Our failure to enforce any rights at any time will not be considered a waiver of those rights.
   c. We have five (5) business days after the formation of a contract to correct any calculation errors in the form and the contract.
3. Rules and Code of Conduct:
   a. You must comply with the academy's rules as outlined in signage and brochures.
   b. The following behaviors will not be tolerated:
   ● Swearing, spitting, loud or disruptive behavior.
   ● Participating in training under the influence of drugs or alcohol.
   ● Misuse or mistreatment of training equipment.
   c. Violating these rules may result in suspension or termination of the Trial membership without a refund. Damages to equipment must be paid for by the Trial member.
4. Right of Trial Membership:
   a. As a Trial member, you have the right to use the GC Team facilities only during the specified class hours and for the duration of your Trial membership.
   b. Trial Membership is based on the right to attend classes and use the facilities, not on actual usage.
5. Suspension of Trial Membership:
   a. At the end of your trial period, if you decide not to continue as a member, your Trial membership will be automatically cancelled.
6. Christmas and Holiday Period:
   a. If you activate your trial Member in the last week of the year, or in the first week of the year, considering the gym is closed during that period, don't worry. As soon as the gym reopens, the trial week will automatically be activated.

8. a. We reserve the right to refuse entry to anyone, including Trial members.
   b. Trial Membership may be terminated without notice for behavior considered threatening, harassing or unsafe.
9. Payment of Fees:
   a. I understand that all memberships require a valid payment card to be linked to a membership account. I authorize one week trial payment from my account.
   b. Without payment required, I understand that my week trial membership will not be activated..
   c. Any fees charged due purchases made at the gym store will be billed directly to the Trial member..
10. Permission for Use of Image:
    a. I agree that GC TEAM ASSOCIATION NZ LIMITED may take photos and make video and audio material of members' classes and other events of GC TEAM ASSOCIATION NZ LIMITED, and these materials may be used for display, promotion, and/or advertising. I hereby waive any compensation I may be entitled to for appearing in such materials.
    b. This includes photos, videos, and social media posts.
    c. The images will not be used inappropriately.
11. Your Physical Condition:
    a. You affirm that you are in good physical condition and capable of engaging in training activities without risk to your health.
    b. If in doubt, it is recommended to consult a medical specialist before training.
    c. Refrain from training if you have a contagious illness, disease, or any condition that poses a risk to others.
12. Pregnancy Policy:
    a. Trial Members who suspect they are pregnant or become pregnant must notify GC Team NZ immediately.
    b. A letter from a general practitioner may be required for continued training with any necessary restrictions.
13. First Aid Consent:
    a. In case of emergency, I authorize any licensed medical personnel or first Aid to perform any accepted medical procedures deemed necessary, and I agree to bear the cost of such treatment. If no licensed personnel are on-site, I agree that instructors or volunteers of GC Team NZ provide any necessary first aid treatment.
14. Indemnification:
    a. Trial Members assume all risks associated with participating in GC Team activities.
    b. GC Team NZ, its instructors, members, and volunteers are not responsible for any claims, losses, damages, or injuries.

In consideration for permission to participate in any form in the classes, events, and/or activities of GC TEAM ASSOCIATION NZ LIMITED, I, the Participant

I understand, acknowledge and accept that Brazilian Jiu-Jitsu is a contact sport and that my participation may result in serious injury, including permanent disability or even death, as well as significant social and economic losses.
I acknowledge and understand that such risk may be due to my own actions, but also to the actions, inaction or negligence of others, participation regulations or the conditions of the premises or any equipment used.
I recognize that there may be other risks not known to me or others, or not reasonably foreseeable at this time.
I will immediately inform an instructor if I believe something is unsafe or beyond my ability and refuse to participate.

On behalf of myself or my kids and my heirs, executors and administrators, I release GC TEAM ASSOCIATION NZ LIMITED, its directors, all instructors, staff and other students within the premises from any damages and liabilities of any kind (including any costs, whether or not subject to a court order) for any type of injury or loss suffered during the training, study, practice or application of Brazilian Jiu-Jitsu, including acts of negligence or gross negligence of the club, whether caused in whole or in part.

DECLARATION OF UNDERSTANDING

I HAVE READ AND UNDERSTAND THE ABOVE WARNING, DISCLAIMER OF LIABILITY, HEALTH ACKNOWLEDGMENT AND ASSUMPTION OF RISK. I SUBSCRIBE VOLUNTARILY WITHOUT ANY INDUCTION, WARRANTY OR GUARANTEE BEING MADE TO ME AND I INTEND MY SUBSCRIPTION TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY.

I CERTIFY AND WARRANT THAT ALL INFORMATION CONTAINED IN THE ABOVE STATEMENTS IS TRUE AND ACCURATE.
